LANDING OF COLUMBUS: 1847 US CAPITOL ROTUNDA
This depicts Columbus’s first landing in the New World, on the island he called San Salvador, on October 12, 1492. Columbus is surrounded by his men on the beach. Discussing the landing in his journal, Columbus wrote that he “leaped on shore, and . . . took, possession of the said island for the King and for the Queen.”[1] In the engraving, he holds a sword in one hand and the royal banner of Aragon and Castile in the other, declaring the discovery for Spain. To the side, Native Americans watch the Europeans from behind a tree. In his journal, Columbus recorded that they “asked us if we had come from heaven” and called them “the best people in the world, and the gentlest.”[2] He also, however, made note of his plan to “with force . . . subjugate the whole island.”[3]

 Red Horse, a Minneconjou Lakota Sioux warrior and acclaimed ledger artist. Red Horse fought against Custer and the 7th Cavalry at the Battle of the Little Bighorn in 1876. 

UNITED STATES V. SIOUX NATION OF INDIANS

In United States v. Sioux Nation of Indians (1980), the U.S. Supreme Court held that an 1877 act of Congress, by which the United States wrested control of the Black Hills of South Dakota from the Sioux Indian Nation, constituted a "taking" of property under the Fifth Amendment, giving rise to an obligation to fairly compensate the Sioux. The Court affirmed a prior decision of the court of claims, which had awarded the Sioux $17.1 million for the taking of the Black Hills, and further held that the tribe was entitled to interest on that amount from 1877. By the late 1990s, the amount due the Sioux had risen to more than $600 million–a payment that the tribe still refuses to accept, choosing instead to continue to seek the return of the land itself.

The United States Constitution provides that the president "shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two-thirds of the Senators present concur" (Article II, section 2). Treaties are binding agreements between nations and become part of international law. Treaties to which the United States is a party also have the force of federal legislation, forming part of what the Constitution calls ''the supreme Law of the Land.''

It wasn’t, of course, just a matter of cultural difference or miscommunication that led to the 19th-century eviction, dispossession and genocide of native people. It was greed and the deeply embedded American conviction, abetted by the Christian religion and enforced with military might, that the white man had a superior right to the land because he was more civilized and could make better use of it.

Transfer the savage-born infant to the surroundings of civilization, and he will grow to possess a civilized language and habit. The school at Carlisle is an attempt on the part of the government to do this. Carlisle fills young Indians with the spirit of loyalty to the stars and stripes, and then moves them out into our communities to show by their conduct and ability that the Indian is no different from the white or the colored…it says to him that, if he gets his living by the sweat of his brow, and demonstrates to the nation that he is a man, he does more good for his race than hundreds of his fellows who cling to their tribal communistic surroundings…I
